Evan Fensterstock – 2022 Rising Star New York Business Litigator

Evan is a trial lawyer, business litigator, and employment lawyer who represents plaintiffs and defendants in multimillion-dollar disputes. Evan founded the complex commercial litigation and employment law firm, Fensterstock, P.C., in 2018. Recently, Evan has successfully had an entire employment related litigation dismissed at the early motion to dismiss phase on behalf of a Defendant employer, and has successfully defeated a Defendant’s motion to dismiss a multi-million-dollar breach of contract and fraud litigation paving the way for discovery and trial ahead on behalf of a Plaintiff corporation.

Prior to the pandemic, Evan won a nearly $5,000,000 judgment for his client after a four-day bench trial in the Commercial Division in New York County.  His practice focuses on breach of contract, breach of fiduciary duty, indemnification, and fraud claims in the commercial arena, as well as litigating employment matters and negotiating employment contracts and separation agreements.

Evan is also a mediator. Evan completed New York’s Part-146 training requirement, making him eligible to sit on the prestigious panel of mediators for New York’s Commercial Division.

Evan is a third-generation business litigator in New York City, descending from his late father, Blair C. Fensterstock, a Top 100 Business Litigator and Columbia Law School graduate, and his late grandfather, Hon. Nathaniel Fensterstock, a former assistant Attorney General in New York.  Evan spearheaded the Holocaust Survivor Representation Pro-Bono Project when he was an Associate at Kasowitz, Benson, Torres & Friedman LLP, which helps Holocaust survivors recoup pensions and payments from the German government for work performed in ghettos during World War II.

Evan graduated cum laude from the New England School of Law where he served as the Executive Literary Editor on the New England Law Review. Evan served as Class President at Bowdoin College where he double-majored in Government & Legal Studies and Spanish.

Fensterstock (1950-2017), Evan Fensterstock’s late father, a Columbia Law Graduate, Harlan Fiske Stone Scholar, and a Top 100 Business Litigator, known for, among other notable matters, trying cases arising out of the 1993 World Trade Center bombings.
