FENSTERSTOCK, P.C., On Behalf of Cypress Group Holdings Inc., Defeats Onex Corporation’s Summary Judgment Motion; Case Proceeds to Trial in March
New York, New York–January 28, 2019–After hearing oral arguments from Fensterstock, P.C., representing Plaintiff Cypress Group Holdings, Inc. (“Cypress”), and Arnold & Porter, representing Defendants Onex Corporation, et al. (“Onex”), the Honorable Justice Barry R. Ostrager of the New York County Supreme Court, Commercial Division, denied Onex’s motion for summary judgment. The decision was made immediately from the bench. The case is set to proceed to trial commencing on March 18, 2019.
The case involves allegations of breaches of representations, warranties, and covenants contained in a stock purchase agreement by Onex in connection with the sale of an insurance company and its subsidiaries.
